Welcome to The Woof Club! The Woof Club website and services are provided by The Woof Club Sàrl, (“The Woof Club” “Woof Club” “we” “us” or “our”). We are registered in Switzerland under the company number CHE-475.548.092. These terms and conditions (these “Terms and Conditions”) govern your (“you” or “your”) access to and use of thewoofclub.ch web site (the “Website”) and all services provided by The Woof Club via the Website including regular subscription products and gift services as well as our one-off boxes and exclusive items (collectively, the “Services”).
The Woof Club provides a subscription service for regular delivery of canine and feline related products for your dog or cat or as a gift to other dog and cat owners, we also provide one-off canine and feline present boxes for your dog or cat, or as a gift to other dog and cat owners. Access to the Website, use of the Services, and purchase of the Products is subject to these Terms and Conditions and The Woof Club Privacy Policy available on the Website.
Acceptance of Terms
By accessing, browsing or using our Website to purchase or subscribe to our Services, you acknowledge that you have read and agreed to be bound by the following Terms and Conditions. Please read the Terms and Conditions carefully, as The Woof Club reserves the right to change them at any time.
Scope of Service
The Woof Club maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions. You are responsible for obtaining any equipment and Internet service necessary to access our Website and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Website may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
Registration and Membership; Product Sales
You must register as a member on our website in order to start your ongoing Woof Club subscription. To register, you must simply provide information about your dog, which will be used to optimise the gift selection, your address and billing information, and a valid email address and password, which will allow us to setup your account on our system. All information that you provide to The Woof Club is subject to The Woof Club’s Privacy Policy. You are responsible for keeping all your account information up to date, this can be done via your personal account page.
As a registered user of The Woof Club, you agree to receiving promotional material via email from The Woof Club. If you do not wish to receive these emails, you can unsubscribe using the button on the email.
Delivery
As a subscribed Woof Club member, we will send you a package either monthly, bi-monthly or quarterly, depending on which frequency you selected. This package will contain a different selection of items for your dog or cat, for example, toys, foods, treats, hygiene products, bones, chews and other canine or feline-related items (“Products”). The selection of products in each delivered package may vary.
BY SUBSCRIBING YOU ARE ENTERING INTO A CONTRACT AND THEREFORE YOU AGREE TO PAY THE SUBSCRIPTION FEE FOR THE PRODUCTS THAT ARE SUPPLIED AT YOUR SELECTED FREQUENCY.
Billing and Payments
The price of the services and/or goods is payable before they are shipped. We currently accept payments by card or Paypal. If you do not cancel your subscription in accordance with the cancellation terms, your subscription will be renewed automatically for an additional subscription period of the same amount of time.
We use a third-party payment service to process your credit card and payment information. By submitting your credit card and payment information, you grant The Woof Club the right to process and store the information with the selected third-party. The Woof Club may change the third-party at any time and you agree that The Woof Club will not be responsible for any failures of the third party to adequately protect such information.
Delivery
Our boxes are delivered by a third-party with the postage paid, delivery fees are included, unless listed during the checkout process. The shipping dates and arrival times are for guidance only.
Local Taxes
You may be charged local sales tax or VAT, if applicable.
International Access
This website may be accessed from outside of Switzerland. If you access and use this Website outside of Switzerland you are responsible for complying with your local laws and regulations.
Membership Cancellations
We work hard to make your membership satisfying; however, you may cancel your ongoing membership through the account page on the Website. You must update your account on the Website by the 22nd day of the month prior to your renewal month.
YOUR SUBSCRIPTION WILL CONTINUE UNTIL YOU CANCEL AND, IF YOU DO NOT CANCEL YOUR MEMBERSHIP PRIOR TO THE 22ND DAY OF THE MONTH PRIOR TO YOUR RENEWAL MONTH, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR A NEW SUBSCRIPTION PERIOD OF THE SAME AMOUNT OF TIME.
All cancellation requests received after the 22nd day of the month prior to your renewal month will apply to the following Subscription Period.
We retain the right to cancel your membership at any time, without notice, for conduct we believe violates these Terms and Conditions or our policies, is harmful our business interests, or for an inactive account.
Limitation of Liability
IN NO EVENT SHALL THE WOOF CLUB OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE TO ANY USER OF THIS WEBSITE OR ANY OTHER PERSON OR ENTITY FOR ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR COSTS OF OBTAINING SUBSTITUTE GOODS OR SERVICES) ARISING OUT OF THE USE, INABILITY TO USE, UNAUTHORIZED ACCESS TO OR USE OR MISUSE OF THE PRODUCTS OR THE WEBSITE OR ANY INFORMATION CONTAINED THEREON, WHETHER BASED UPON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.
YOU AGREE THE WOOF CLUB’S TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THESE TERMS AND CONDITIONS, THE WEBSITE, THE CONTENT, OR ANY PRODUCT OR SERVICES WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE WOOF CLUB IN THE THEN-PRIOR CALENDAR MONTH.
Indemnification
By using this Website, our Services, or supplied Products, you agree to indemnify, hold harmless and defend The Woof Club from any claims, damages, losses, liabilities, and all costs and expenses of defence, resulting directly or indirectly from a claim by a third party that arises in connection with use of this Website, Services, or Products by you or any other person accessing the Website using your member login account.

Although The Woof Club does not claim ownership of submitted content, when you submit content you agree to grant us license to use such content. This license shall remain in effect until we delete the Content from our systems.

YOU ARE RESPONSIBLE FOR DETERMINING THE SUITABILITY OF PRODUCTS FOR USE OR CONSUMPTION BY YOUR DOG. WE ARE NOT ABLE TO PROVIDE ANY GUARANTEES REGARDING ALLERGIES.
Under no circumstances will we be liable for any loss or damage caused by your use of the Products. You agreed that the sole and exclusive outcome arising from or relating to any product will be either its replacement, or a credit towards another shipment, this is at The Woof Club’s discretion.

SOME AREAS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
